When an unmarried couple separate, the Judge, if asked to do so, will apply completely different principles to the division of the jointly owned assets than would be the case in divorce proceedings.  

Where an asset is owned in joint names, unless there is evidence to the contrary, it is likely to be owned in equal shares.  However there may have been an agreement that the asset is owned disproportionately. 

As a general rule upon separating, each person keeps those assets which are held in their sole name, unless the other can show that they either contributed to the purchase or improvement of that asset or that it was intended that they should have a financial interest in the asset.
